Preamble
Our general terms of sale shall prevail over any other terms,
unless exempted specially and exceptionally in writing by
us.
All of the company's sales media are intended for professionals
(retailers, trade, liberal professions, businesses, government
bodies, public and private authorities, associations, etc.)
These general terms of sale are applicable to all orders placed
on the www.edimeta.fr
website.
EDIMETA reserves the right to modify the general terms of
sale at any time. |
Prices
The prices quoted on the site and other sales media are guaranteed
until the stated validity date. The prices are displayed in
euros per unit excluding VAT, with VAT in addition at the official
rate in force at the order date. The delivery charges stated
on the site's product sheets are valid for shipping in accordance
with the delivery times usual in continental France and Corsica.
EDIMETA reserves the right to modify the prices quoted on the
site and other sales media at any time. The products will be
invoiced according to the prices in force on the day that the
order is recorded and subject to availability. |
Transport
The products ordered always travel at all risks and costs of
the purchaser of the delivery, who must check on their arrival,
in the carrier's presence, the number of packages and the condition
of the goods and, in the event of any goods being seen as missing
and/or damaged, immediately record their "detailed"
handwritten conditional acceptance of the goods on the carrier's
delivery slip. Confirmation of this conditional acceptance must
be sent within 48 hours, by registered letter with acknowledgment
of receipt, to the carrier, and a copy must be sent to EDIMETA
(Articles 105 and 106 of the French Commercial Code).
In the event of the recipient not performing these formalities
within the required period, it is impossible to take any recourse
against the carrier. |
| Products
and specifications
The details and technical specifications of the products sold
and delivered are those appearing throughout our sales media,
catalogues and website, and comply with French laws currently
in force. However, we reserve the right to make any change
at any time to the products in order to improve their quality
and, in this case, we undertake to inform the customer of
the fact immediately by letter, when the order is taken.
If an order is destined for a foreign country, the customer
must check with the local authorities that the products comply
with the applicable legislation and any import restrictions
or conditions restricting the use of the products ordered.
The texts, illustrations and photos used to present the products
on the website and other sales media are non-contractual and
cannot incur the liability of EDIMETA in any way whatsoever.

Claims
- Returned goods
Claims must be made by telephone or fax as soon as the goods
are received.
Before returning any goods, please contact our sales department
on +33 (0)1 46 81 33 03.
No goods may be returned without our prior written agreement.
Supplies that have been ordered using an order form and whose
delivery has not been the subject of a claim within 15 days
of their receipt shall in no event be returned to us and accepted
unless this has been accepted in writing on our part.
Personalized and/or custom-made products are never returned
or exchanged. |
Terms
of payment
Government or public authorities:
Full payment within 45 days of delivery and invoicing, by
bank transfer, administrative mandate or check.
Stores and retailers:
30% downpayment enclosed with the order; the balance on delivery
Check for the full amount enclosed with the order
Payment of the full amount to the carrier on delivery. No
additional charge if goods are paid for on delivery.
Works councils:
Full payment within 30 days of delivery and invoicing, by
check or bank transfer.
Companies:
30% downpayment enclosed with the order; the balance on delivery
Check for the full amount enclosed with the order
Payment of the full amount to the carrier on delivery. No
additional charge if goods are paid for on delivery.
Individual customers:
30% downpayment enclosed with the order; the balance on delivery

Liability
In no event shall EDIMETA be held liable for the consequences
of the use of its equipment on other goods, and/or any direct
or indirect damage caused.
We also shall not be liable in the event of abnormal use being
made of our products. In case of defects in the delivery, our
liability shall be limited to replacing the products concerned
and shall exclude all other costs or compensation. |
Warranty
and customer support
Our products are covered by a one-year warranty. The invoice
serves as a warranty document. Unless expressly agreed otherwise,
the customer shall be responsible for the packaging and transport
costs incurred in returning and redispatching the equipment.
EDIMETA provides its own customer service. Non-warranty repairs
shall be subject to quotation and shall be carried out only
after the customer expressly agrees to the repair by returning
the signed quotation. In this case, the sender is responsible
for the cost of sending the faulty product to our repair workshops. |
Reservation
of title
It is expressly agreed that EDIMETA retains full and exclusive
ownership of goods sold until full payment of their price is
made. In this respect, the issuing of a bill of exchange or
other instruments creating an obligation to pay shall not constitute
payment (French law 80335 of 15 May 1980.)
EDIMETA reserves the right to repossess the goods concerned
at any time. |
Disputes
- Legal jurisdiction
The Paris Commercial Court shall have jurisdiction over all
claims and disputes, irrespective of their reason, unless an
amicable settlement can be reached. |
French
Law on Personal Data Protection
In accordance with the French Law of 6 January 1978, the customer
is legally entitled to access, correct or oppose their personal
data held by EDIMETA. Customers have the right to request by
letter that their contact information is removed from the customer
details file and/or that their contact information is not provided
to third parties. |
